Are dogs euthanized if they bite someone on private property?
My mother has a Rat Terrier that I rescued for her over a year ago. My cousin is a drug addict and hangs out around there when she isn’t home, she has walked in on him hitting the dog before.
Last week he hit Jimmy (the dog), while my mom was gone, with a broom which has caused horrible damage to his teeth which need to be operated on (he’s on pain pills right now).
He said that Jimmy attacked him, which is BS and also said that next time “he bites” he is having him put to sleep.
He is a sweet dog, I don’t live there and my cousin isn’t allowed there. Is he able to do this to the dog under these conditions?
***If I took the officers of Animal Control there they would see that he is a friendly dog. He loves to kiss and wag his tail. He also walks on his back paws to get your attention.
Just want to be clear. as I understand it:
Dog was on private property; cousin was trespassing.
If so, see if you can find a witness to the hitting, trespassing, cousin’s rant and/or abuse. Or, tell you cousin you would like a recording from him so that you can follow up with a dog expert to make sure the dog does not bite him again (this is true, be nice, he does not need to know your method). Try to get him to explain the abuse and the threat. The more evidence you can collect, the better. If you can also collect evidence on his drug abuse, this would only bolster your case.
Take the vet bill and all witness/evidence (for a tape-make sure on the tape you ask your cousin if he knows he is being recorded and he says yes) to the nearest animal care and control, humane society, or law enforcement agency.
Your mother, as property owner, must be willing to press charges. Explain that you would like to:
a) press charges for abuse to animals
b) press charges for vagrancy
c) get a restraining order for destruction of property (the dog) and for personal safety (your mother) due to your cousins threats and volatile behavior.
If you have difficulty obtaining evidence, go to the local law encforcemant or humane society and ask about the laws in your state and town. Then, set up a surveillance camera in the area where the abuse is occuring so that you can capture any future incidents on tape.
If your mother refuses to press charges, I recommend that you remove the dog from the property. Yes, your cousin is wrong. I just think the first priority should be to protect your mother and the dog. If your mother will not start legal action, then you must take other means to ensure both of their safety from an abusive individual.
I’m sorry for the situation you face. It is not easy. It sounds as though limits must be placed with this individual in any case, dog or no dog.
